Please note that this is an on site job at Silao, Guanajuato. The Contract & Claim Manager will report operationally to the Project Lead, who will act as the main point of contact, (FIDIC and No FIDIC) for task planning, supervision, and performance review. The CCM will also coordinate closely with the Project Lead and relevant functional teams. Formal validations will be performed by Legal, Procurement, Finance, and PMO as per internal governance. Overview of the role Overseeing the contractual and claims management process during execution Collaborating with multiple teams to optimize project outcomes Ensuring compliance with contractual obligations and helping mitigate risks Overseeing project execution and leading the contract management execution strategy Helping ensure that the project is completed on time and within budget, as much as possible INTERFACES The CCM will work in close coordination with: Project Lead & PMO: Collaborates with Project Lead and Project Management Office to align contractual obligations with project timelines Procurement Team: Works with Procurement to address risks, negotiate claims, and manage supplier relationships Legal and Compliance Team: Consults on legal compliance and on claim and dispute resolution strategies Technical Workstream Leads (Engineering, MEP, Automation, etc.) Ensures that contract execution aligns with technical specifications and scope Finance & Project Controlling: Coordinates budget management, invoice checking, payment approvals, and financial audits FIDIC Engineer: Works with the FIDIC Engineer during change management, testing and inspection, and payment certification processes, among others Quality Assurance/Quality Control/Quality Management Team: Collaborates on quality control and compliance checks Health, Safety & Environmental Team: Engages with HSE to ensure health, safety, and regulatory compliance Senior Management & Other Internal Stakeholders: Advises senior management and other internal stakeholders on project progress and contractual risks and opportunities KEY RESPONSIBILITIES Contract and Communication Management (during execution phase) Communication of contract terms (esp. FIDIC), like scope, obligations, rights, and remedies to internal stakeholders. Single point of contact for contractors, on Employer’s behalf, in relation to claims and other formal correspondence. Coordination with project, technical, legal, etc. teams in drafting communications and responses to contractors, FIDIC Engineer, and other stakeholders. Claims and Oversight Management Maintaining and supervising claims overview. Claims management, including drafting and timely filing of notices, claims, comments/oppositions, and counterclaims. Establishing a systematic approach for documenting and monitoring claims and their resolution (e.g., claims register, claims lessons learned register, monthly claims status reporting, etc.). Change Management Management of variations, change orders, and/or amendments, including preparation of initial drafts and conduct of regular reviews these changes and variations. Milestones and Obligations Management Monitoring contract milestones, program, deviations, and performance metrics. Maintaining a commitment or obligations register. Supporting Negotiations for Claims and Disputes Supporting Procurement in negotiating and drafting settlement agreements on claims, variations, and/or disputes. Implementing lessons learned on claims and disputes from previous projects. Financial Monitoring Supervision, administration, and monitoring of bank bonds, performance and warranty securities, insurance certificates, etc. Financial and progress monitoring and reporting. The proposed candidate should meet the following qualifications: Degree in Engineering or related field. Minimum 3 years of experience in contract & claims management (esp. under FIDIC Frame) Track record in execution of complex industrial/infrastructure projects (e.g., execution of at least two or three construction projects from post-signing until handover to the Operations Maintenance Team). Management in claims and variations experience is required. High proficiency in English (spoken and written) Strong legal awareness and negotiation skills Strong communication skills Comfortable working across functions and managing external stakeholders Ability to detect potential risks early and implement proactive measures to minimize impact Experience with CAPEX project lifecycles and documentation Skilled in evaluating complex scenarios and developing effective solutions. Proficient in reading, drafting, and communicating contractual matters. experienced in reviewing project timelines and contractual documentation to ensure compliance and accuracy. Knowledge of LOPSRM (Ley de Obras Públicas y Servicios Relacionados con las Mismas) and RLOPSRM (Reglamento de la Ley de Obras Públicas y Servicios Relacionados con las Mismas) is a must.
